Wikileaks: Insights on Palestine from the Cables

New Left Project | By Asa Winstanley* | 24.12.10

One of the first things that struck me while reading the cables from the US embassy to Israel in Tel Aviv was how worried the Israeli government seems to be about the Goldstone Report into war crimes committed during Israel's 2008-2009 attack on the people of Gaza. In cable 09TELAVIV2777 of December 2009, Israeli Prime Minister Benjamin Netanyahu is said to have named the report as one of three "principal threats" facing Israel - the other two being Iran's alleged nuclear programme and "missile proliferation".

Second, there are important insights into the high level of collaboration between Israel and forces that have been called the "Palestinian Contras" in the occupied West Bank and Gaza Strip. Indeed, the first "cablegate" headline on Palestine was sourced from cable 09TELAVIV1177, in which Israeli Defense Minister Ehud Barak is reported to have said he "had consulted with Egypt and Fatah prior to Operation Cast Lead, asking if they were willing to assume control of Gaza once Israel defeated Hamas". In other words, Fateh leader Mahmoud Abbas (whose term as PA president expired in January 2009) knew the massive Israeli onslaught was coming but said nothing. This was widely suspected, but to read confirmation of it from a confidential US government source is something new.

There's more. Cable 07TELAVIV1732, which I like to call "War of the Puppets", was released this week. To my mind, it's the most interesting of the Palestine cables released so far. Written in June 2007 during Gaza street-fighting caused by the ultimately unsuccessful Fateh coup attempt, it details a meeting between then-ambassador Richard H. Jones and Yuval Diskin (head of Israel's secret police, the Shabak - aka Shin Bet). It is a portrait of how divided Israel's Palestinian collaborators really were. "[Gaza warlord Mohammed] Dahlan is trying to manage Fatah's security forces by remote control. We are not even sure where he is... " Diskin is quoted as saying. He continued: "[Dahlan's men in Gaza] ask us to attack Hamas. This is a new development. We have never seen this before. They are desperate." Again, this is all important corroborating evidence for things we already knew or suspected. Recent media reports of a power struggle between Abbas and Dahlan (whom Fateh elements close to the US now blame for "losing" Gaza) suggest little has changed in terms of Fateh infighting.

Diskin is also reported in 07TELAVIV1732 to have claimed the Shabak had "a very good working relationship with the [Palestinian Authority] Preventive Security Organization (PSO) and the General Intelligence Organization (GIO)." The most striking quote in the whole cable to me is this: "Diskin said that the PSO shares with ISA [Shabak] almost all the intelligence that it collects".

There is also something of an overlooked smoking gun in this cable. Of Tawfik Tirawi, leader of the PA's GIO: "Diskin said... he is trying to develop ties with the Dughmush family in the Gaza Strip.'" The Doghmush clan (aka the "Army of Islam"), you may recall, are the same group that in March 2007 kidnapped BBC journalist Alan Johnston (he was rescued by Hamas in July). While a Fateh connection to the group has long been suspected, to my knowledge this is the first confirmation of it from official sources.

Overall, this is a Palestinian Authority acting as nothing more than an extension of the Israeli occupation forces – a relationship that has only deepened in the last three-and-a-half years. However, there is a lot missing in the cables: little on the 2008-2009 Israeli assault on Gaza, nothing on the assassination of Mahmoud al-Mabhouh in Dubai and little on the July 2006 Israeli war on Lebanon. Despite some rather unlikely conspiracy theories currently doing the rounds on the internet, the likely reasons for these gaps are more mundane. First, none of the cables are rated "Top Secret"; second the inherent bias of US government personnel towards Israel; and third, only a small fraction of the leaked cables have actually been published so far. Indeed, during an interview with Al Jazeera this week, Julian Assange claimed they had thousands of cables on Israel still to come, including material on the al-Mabhouh assassination and the July 2006 war.

Also, of note is a graph illustrating the composition of the cables cache on the Wikleaks website. It appears to show that around 2000 cables from the US consulate in Jerusalem are still to come. These could be more interesting than the cables released so far (almost all from the embassy in Tel Aviv).

To be continued, in all likelihood.

French activists arrested at West Bank protest
(AFP) – 1 hour ago

JERUSALEM — Nine French activists were arrested on Sunday during a pro-Palestinian demonstration at a major Israeli checkpoint in the West Bank, police and protest organisers told AFP.

"Our forces today dispersed protesters who were throwing rocks at us and proceeded to arrest nine people, including some foreigners," Micky Rosenfeld said.

"The protest took place at the Qalandia checkpoint, north of Jerusalem, and the police made arrests after the activists tried to cross the checkpoint," he added.

A spokesman for the French EuroPalestine activist group said nine French citizens were arrested at the demonstration. A Palestinian detained at the protest was later released, he said

On Saturday, another French activist, Layli Ben Saffi, was arrested by the Israeli military during a protest against Israeli settler activity in the West Bank city of Hebron. He was released on Saturday evening.

Some 70 members of the EuroPalestine group have spent the last week in the Palestinian territories on an observer mission, a group spokesman said.

The president of the organisation, Olivia Zemor, was deported last Wednesday "on the recommendation of the security services," after being detained at Ben Gurion upon arrival.

Gooide iemand daar iets? Ronny, twitteren joh!

Jawel, zeer gewelddadig, die "stenengooiers"

Oog kwijt geraakt door traangasgranaat.

Nog een traangasgranaat.

Geweld.

Dehaene versus Van Agt

Sssst...

There Is No Freeze

Palestine Monitor | 21 September 2010

With eleven days left until the end of the settlement freeze, the construction company Naot Pisgah decided to jump the gun. Despite the current peace talks hinging critically on the issue of continued illegal construction in Palestinian territory, the company started construction 14 September in Modi'in Illit.

Naot Pisgah saw themselves with little financial options. The internationally-supported moratorium on construction in the West Bank cost them nearly $48 million, according to their since rejected compensation lawsuit filed against Israel.

The company's tractors were clearing ground for 750 homes out of a planned 3,000 at the third largest settlement in the West Bank, when inspectors arrived from the Civil Administration – the Israeli organisation empowered since Oslo authority in the area. They ordered Naot Pisgah to stop their work obviously flouting the freeze signed by President Benjamin Netanyahu.

But when the inspectors left, the construction continued.

A team from human rights organization Yesh Din investigated Modi'in Illit after the Naot Pisgah was ordered to stop, and they found buildings still being raised. All of the construction is on land legally part of the Palestinian village Bil'in, which has lost most of its lucrative farmland to the construction of the settlement and the separation wall.

According to human rights group B'Tselem, the ultra-orthodox settlement also known as Keryat Sefer has grown by leaps and bounds at the expense of neighbouring villages Bil'in and Nil'in. Founded after Oslo in 1996, Modi'in Illit was recognised as a city in 2005 and has grown to 36,282 people.

The Israeli government was fully aware of the illegal expansion – they even recorded it. According to a Defense Ministry database originally leaked by Yesh Din, Modi'in Illit had an illicit construction boom: six multi-story buildings, 23 condominiums, an emergency service center, nine school trailers, an industrial zone, a compound of 20 trailers and many other partial, complete or mobile units.

Construction was never frozen at Modi'in Illit.

"It is is growing rapidly," said Hagit Ofran, Settlement Watch project directorate at Peace Now, who visited Modi'in Illit a week before Naot Pisgah's bulldozers. "We saw there were many violations of the [freeze] order. I saw three new buildings that are now being started with a concrete floor. This is not supposed to happen according to the military order."

Outside of Israeli law, the settlement's municipal council issued permits for the buildings. After they were constructed, the Civil Administration approved them, in effect supporting illegal expansion. Since 1967, Israel extended settlement authority over 42 percent of the West Bank and goaded nearly half a million settlers there, according to a B'Tselem report.

"The settlement enterprise has been characterised, since its inception, by an instrumental, cynical, and even criminal attitude toward international law, local legislation, Israeli military orders, and Israeli law," stated the report, titled By Hook and By Crook. "This attitude has enabled the continuous seizure of land from Palestinians in the West Bank. Israel has ignored the explicit prohibitions in international law on establishing settlements, offering its own interpretation for their establishment, an interpretation that has not been accepted by almost any jurists in the world or the international community."

Once the freeze expires on 26 September, Israeli companies and settlement organisations are planning a massive explosion in construction inside Palestinian occupied territory. According to a report by Peace Now, the day the freeze ends, construction will start on 2,066 homes on land outside the jurisdiction – but under the direct military and political influence – of Israel.

Many doubt President Netanyahu's ability, or desire, to stop the settlement expansion because a continued freeze would fracture his coalition government - and his father would disapprove. In an interview with Israel's Channel II, Ben-Zion Netanyahu said his son is sabotaging the peace talks with impossible demands on the Palestinians.

"They will never accept these conditions," Ben-Zion said. "Not one of them."

According to an interview between a Knesset member and Atlantic Magazine correspondent Jeffrey Goldberg, "the chance for movement toward the creation of an independent Palestinian state will come only after Ben-Zion's death."

"Bibi [Netanyahu] could not withdraw from more of Judea and Samaria [the West Bank]" said the MK to Goldberg, "and still look into his father's eyes."

Formalizing Israel’s Land Grab

Truthdig | by Chris Hedges | August 16, 2010

Time is running out for Israel. And the Israeli government knows it. The Jewish Diaspora, especially the young, has a waning emotional and ideological investment in Israel. The demographic boom means that Palestinians in Israel and the occupied territories will soon outnumber Jews. And Israel’s increasing status as a pariah nation means that informal and eventually formal state sanctions against the country are probably inevitable.

Desperate Israeli politicians, watching opposition to their apartheid state mount, have proposed a perverted form of what they term “the one-state solution.” It is the latest tool to thwart a Palestinian state and allow Israel to retain its huge settlement complexes and land seizures in East Jerusalem and the West Bank. The idea of a single state was backed by Moshe Arens, a former defense minister and foreign minister from the Likud Party, in a column he wrote last month in the newspaper Haaretz asking “Is There Another Option?” Arens has been joined by several other Israeli politicians including Knesset Speaker Reuven Rivlin.

The Israeli vision, however, does not include a state with equal rights for Jewish and Palestinians citizens. The call for a single state appears to include pushing Gaza into the unwilling arms of Egypt and incorporating the West Bank and East Jerusalem into Israel. Palestinians within Israeli-controlled territory, however, will remain burdened with crippling travel, work and security restrictions already in place. Palestinians in the occupied territories, for example, cannot reclaim lost property or acquire Israeli citizenship, yet watch as Jews born outside of Israel and with no prior tie to the country become Israeli citizens and receive government-subsidized housing. Palestinians in the West Bank live in a series of roughly eight squalid, ringed ghettos and are governed by military courts. Jews living in the West Bank and East Jerusalem, like all full Israeli citizens, are subject to Israeli civilian law and constitutional protection. Palestinians cannot serve in the armed forces or the security services, while Jewish settlers are issued automatic weapons and protected by the Israel Defense Force.

If Israel sheds Gaza, which has 1.5 million Palestinians, the Jewish state will be left with 5.8 million Jews and 3.8 million Arabs. And, at least in the near future, Jews will remain the majority. This seems to be the main attraction of the plan.

The landscape of the West Bank and East Jerusalem, known as “facts on the ground,” has altered dramatically since I first went to Jerusalem over two decades ago. Huge fortress-like apartment complexes ring East Jerusalem and dominate the hillsides in the West Bank. The settler population is now more than 462,000, with 271,400 living in the West Bank and East Jerusalem, and 191,000 living in and around Jerusalem. The settler population has grown at the rate of 4.6 percent per year since 1990 while the Israeli society taken as a whole has grown at 1.5 percent.

The net effect of the Israeli seizure of land in East Jerusalem, which includes recent approval for an additional 9,000 housing units, and the West Bank is to promulgate a form of administrative ethnic cleansing. Palestinian families are being pushed off land they have owned for generations and evicted from their homes by Israeli authorities. Dozens of families, tossed out of dwellings they have occupied in East Jerusalem for decades, have been forced onto the streets. Groups such as Ateret Cohanim, an ultra-Orthodox Jewish private organization that collects funds from abroad, purchases Palestinian properties and pursues legal strategies to evict families that have long resided in East Jerusalem. Israel’s judicial system and police, in violation of international law, facilitate and enforce these evictions and land seizures.

Heavily armed settlers carry out frequent unprovoked attacks and ad hoc raids and house evictions to supplement the terror imposed by the police and military. They are the civilian arm of the occupation.

“This acquiescence in settler violence is particularly objectionable from the perspective of international humanitarian law because the settlers are already unlawfully present in occupied territory, making it perverse to victimize those who should be protected—the Palestinians—and offer protection to those who are lawbreakers—the settlers,” said Richard Falk when we spoke a few days ago. Falk is the U.N. special rapporteur who was denied entry into the occupied territories by the Israeli government.

Falk said that incorporating Palestinians in East Jerusalem and the West Bank into a single Israeli state would see Israel impose gradations of citizenship.

“If the Palestinians in pre-’67 Israel enjoy second-class citizenship, those in the West Bank and East Jerusalem will be given a third-class citizenship,” Falk said. “The real proposal, the envisioned outcome of this kind of proposal, is an extension of Israeli control over the occupied territory as a permanent reality. It is presently a de facto annexation. The creation of a single state would give the arrangement a more legalistic cover. It would seek to resolve the issue of occupied territory without the bother of international negotiations.”
“The effect is to fragment the Palestinian people in such defining ways as to make it almost impossible to envision the emergence of a viable Palestinian sovereign state,” said Falk. “The longer it continues, the more difficult it is to overcome, and the more serious are the abridgement of fundamental Palestinian rights.”

Falk, who taught international law at Princeton University, will issue a report to the United Nations this fall in which he will assert that the Israeli process of colonialism and apartheid has accelerated over the past three years. He will call in the report for the U.N. to consider unilaterally declaring Palestine an independent state, as it did with Kosovo. Falk cites as examples of Israeli colonialism the official 121 Jewish settlements, as well as roughly 100 “illegal outposts” in the West Bank, and the extensive network of roads reserved exclusively for Jews that connects the settlements to one another and to Israel behind the green line. He estimates, when “all restrictions on Palestinian control and development are taken into account,” that Israel has effectively seized 38 to 40 percent of the West Bank.

The punishing conditions imposed by the Israeli blockade of the 1.5 million Palestinians living in Gaza have been replicated for the roughly 40,000 Palestinians who live in “Area C,” the 60 percent of the West Bank that remains under complete Israeli military control. Save the Children, UK (STCUK), in a recent report called “Life on the Edge” argues that Israeli policies of land confiscation, expanding settlements, lack of basic services such as food, water, shelter and medical clinics are at “a crisis point.” The report concludes that food security problems are even worse than in Gaza. According to the report, “ ... Seventy-nine percent of communities surveyed recently don’t have enough nutritious food; this is higher than in blockaded Gaza where the rate is 61 percent.” Palestinian children growing up in Area C experience, according to the report, malnutrition and stunted growth at double the level of children in Gaza. Forty-four percent of these children were found to suffer from diarrhea, often with lethal effects. STCUK writes that “Israel’s restrictions on Palestinian access to and development of agricultural land—in an area where almost all families are herders—mean that thousands of children are going hungry and are vulnerable to killer illnesses like diarrhea and pneumonia.”

“Children are being forced to cross settlement areas and risk beatings and harassment by settlers, or walk for hours, just to get to school ... many children are losing hope in the future,” Jihad al-Shommali of the Defense for Children International Palestine Section was recently quoted as saying with reference to the problems of children in Area C.

Falk said, “This overall pattern suggests systematic violations by Israel of Article 55 of Geneva IV and Article 69 of the First Geneva Protocol of 1977 that delimits Israel’s obligations to ensure adequate provision of the basic needs of people living under its occupation, especially in Area C where it exercises undivided control.”

The annexation of Palestinian territory has been reinforced by the construction of 85 percent of the separation wall—256 of a planned 435 miles has been completed—on occupied Palestinian territory. The barrier cuts the West Bank off from Israel and has been built in a configuration which plunges deep into the West Bank. The settlements and the land to the west of the wall, which makes up 9.4 percent of the West Bank, have already been absorbed into Israel. The seizure of nearly 40 percent of the West Bank includes Israeli control of most of the Palestinians’ water supply. The Jewish settlers in the West Bank are allotted per capita four to five times the amount of water allotted to Palestinians by the Israeli government.

The settlements in East Jerusalem and the West Bank violate Article 49(6) of Geneva IV, which prohibits the transfer of the population of an occupying power to the territory temporarily occupied. Israel’s stubborn rejection of the demand of Security Council Resolution 242 that it withdraw from Palestinian territories it occupied in 1967 creates, as Falk said, “a background that resembles, and in some dimensions exceeds, in important respects the situation confronting the government of Kosovo.”

“Lengthy negotiations have not resolved the issue of the status of Palestine, nor do they give any reasonable prospect that any resolution by negotiation or unilateral withdrawal will soon occur,” he said. “Under these circumstances, it would seem that one option available to the Palestine Liberation Organization [the Oslo Agreement empowered the PLO to negotiate international status issues] acting on its own or by way of the Palestinian Authority under international law would be to issue a unilateral declaration of status, seeking independence, diplomatic recognition and membership in the United Nations. The recent Kosovo advisory opinion of the World Court in The Hague provides a well-reasoned legal precedent for such an option.”

Children in West Bank facing worse conditions than in Gaza

Areas of the West Bank under complete Israeli control have plummeted into a humanitarian crisis worse than Gaza, Save the Children warns.

A new report, "Life on the Edge", released today, states that an estimated 40,000 Palestinians living in Area C - the 60% of the West Bank under Israeli control - are unable to make urgent repairs to their sewage systems, schools, homes or hospitals under Israel's strict permit system.

Israel's restrictions on Palestinian access to and development of agricultural land – in an area where almost all families are herders - mean that thousands of children are going hungry and are vulnerable to killer illnesses like diarrhoea and pneumonia.

Conditions for children in Area C have reached a crisis point:
79% of communities surveyed recently in Area C don't have enough nutritious food - this is higher than in blockaded Gaza where the rate is 61%.

84% of families rely on some form of humanitarian assistance to survive.
Rates of stunting in Area C are more than double than in Gaza. More than 15% of children under-5 surveyed were underweight.

An alarming 44% of children in the surveyed area have diarrhoea – the biggest killer of children under-5 in the world.

Salam Kanaan, Save the Children UK's Country Director said: "in the past week, the international community has rightly focused its attention on the suffering of families in Gaza but the plight of children in Area C must not be overlooked.
"Palestinians in the West Bank are widely thought to enjoy a higher standard of living but tragically many families, particularly in Bedouin and herder communities, actually suffer significantly higher levels of malnutrition and poverty."

Across Area C, children are forced to learn in overcrowded, makeshift classrooms without electricity, access to functioning toilets or safe drinking water. Aid agencies are limited in what they can do to help by tight restrictions on building imposed by Israel.

Salam Kanaan said: "Palestinian children cannot wait for the stalled peace talks between the Palestinian Authority, Israel and the United States to find solutions to this crisis. Urgent action must be taken by the Palestinian Authority and the international community to ensure that children have safe homes and proper classrooms, enough food to eat and clean water to drink."
Save the Children works with the most vulnerable children in Area C providing counselling to children whose homes have demolished along with stationary and books for school. The organisation also does urgent repairs to damaged buildings and agricultural land where possible.

Amnesty Nederland | Simone Korkus | uit Wordt Vervolgd, februari 2010

  • tienduizenden Palestijnse families hun woning dreigen te worden uitgezet;
  • 49 procent van de Palestijnen sinds 2000 minstens een keer met ontruiming te maken heeft gehad;
  • slechts 37 procent van de Palestijnen er voldoende te eten heeft;
  • 92 procent geen toegang heeft tot medische voorzieningen.
Een VN-rapport uit december 2009 stelt dat:
  • Palestijnse bouw in 70 procent van zone C (oftewel 44 procent van de Westoever) effectief door Israël verboden is omdat die grond tot staatseigendom is verklaard of tot gesloten militair terrein;
  • vergaande beperkingen de aanvraag van bouwvergunningen door Palestijnen in de resterende 30 procent van zone C praktisch onmogelijk maken;

As settler violence escalated, even children on their way to school in At’tuwani were not spared. Eventually, the Israeli Army agreed to provide an escort for children traveling from Taba to At’tuwani for their daily classes. Ironically, the same soldiers would invade the villages at night. One can only wonder whether the children think of the soldiers as protectors or agents of oppression. Taken on February 24, 2009.

The military statement said Israeli forces had been authorised to use rubber bullets against the Palestinians, but, as reported by The Independent, medics who examined the body insisted that live ammunition had been used, and produced X-rays that appeared to show a conventional bullet lodged in the skull of Osaid Qadus. [zie foto]
The Israeli army said a Military Police investigation into the claims that live rounds were used was still ongoing. The army "could not verify the autopsy and could therefore not confirm that the rioters were in fact hit by live rounds," the statement said.

Palestinians pray over the bodies of Mohammed Qadous and his brother Sayid Qadous during their funerals in the West Bank village of Iraq Burin, near Nablus, Sunday, March 21, 2010. Mohammed and Sayid Qadous were killed after they were shot by Israeli soldiers during a demonstration Saturday near the West Bank village of Iraq Burin, Palestinians said. Israelis said no live ammunition was used.

Palestinian protesters and relatives of Mohammed and Salah Qawariq, who were killed by Israeli soldiers last week, gather at the site where both men were killed in the West Bank village of Awarta, near the Jewish Settlement of Etmar, on March 26, 2010. Israeli soldiers shot and killed the two Palestinian men on March 21, 2010.

Incident: Awarta
Doden: Mohammed Qawariq (20) and Salah Qawariq (19)

(bron)

The Independent:

In Awarta a day later, an Israeli soldier fired on two Palestinians who approached a checkpoint and started "acting suspiciously," according to the statement. The first apparently tried to attack the soldier with a bottle, prompting the soldier to shoot him. The second then allegedly wielded a "sharp object" and was also shot dead.
The soldier fired seven bullets into Mohammed Qawariq and at least three into Saleh Qawariq, according to Palestinian doctors. "While the soldier, believing his life was at risk, acted subjectively, the Chief of the General Staff holds the officers responsible for training their soldiers to act in difficult operational situations," the military said.
Relatives of the deceased denied that they tried to attack the soldier and said they were only metal workers looking for scrap.

New Israeli Military Orders Expelling West Bank Palestinians

Tomorrow, 13 April 2010, two new Israeli military orders will come into effect, potentially turning all West Bank residents into “infiltrators”.

Order No. 1650 regarding Prevention of Infiltration and Order No. 1649 regarding Security Provisions were issued in October 2009 as amendments to an old military order (1969) which declared “infiltrators” coming from Jordan, Syria, Egypt or Lebanon (the so-called “enemy states” at the time of the issuance of the order) liable to imprisonment and deportation.

The new orders define an “infiltrator” in such generic terms that virtually any person currently present in the West Bank could potentially fall under that definition and consequently incur criminal liability and/or be subject to deportation.

An “infiltrator” is defined as “a person who entered the Area unlawfully” or “a person who is present in the Area and does not lawfully hold a permit”. The ‘Area’ refers to the occupied West Bank.

Pursuant to Military order No. 1650 any person who unlawfully entered the area shall be sentenced to seven years imprisonment, whereas an individual who has lawfully entered the area but does not “hold a permit” shall be sentenced to three years imprisonment.

Moreover, regardless of whether the “infiltrator” is charged with an offence under the Order or not, the military commander may order the deportation of the person from the area; the issuance of the deportation order shall be considered as an arrest order and serve as the “legal source for holding such infiltrator in custody pending his deportation”. The deportation can be executed 72 hours after the order, and in some cases even sooner.

As a consequence of the dramatic expansion and ambiguity of the new definition of “infiltrator” the Order not applies to people coming from so-called “enemy states”, as in the past; it now applies to every Palestinian, both those who were born in the West Bank and those who lawfully moved to it, for instance from Gaza or from abroad.

The new regulation establishes that every person without a document or permit is “presumed to be an infiltrator”. According to Order 1650 the permit is a document issued by the military commander, or a person appointed by him in accordance with security legislation, or by Israeli authorities under the Entry into Israel Law, 5712-1952. As has been highlighted by Hamoked

Center for the Defence of the Individual, the broadness of the definition suggests that the Order applies to every person currently present in the West Bank regardless of his status, identity, or nationality.

In fact over the past number of years, thousands of applications made by persons living in the occupied Palestinian territory (oPt) since decades in accordance with the Interim Agreement between Israel and the Palestinian Authority or by Palestinians seeking family reunification have been illegally “frozen” by the Israeli authorities who refused to grant them status in the oPt.

Additionally, since 1967 thousands of Palestinians moved to the West Bank from the Gaza Strip  and they were never required to have a written permit, as there was no requirement under the military legislation to hold a written permit.

It appears that pursuant to the new military orders thousands of residents in the West Bank will be potentially subject to immediate deportation.

Such a practice would constitute a breach of the Fourth Geneva Convention, and in particular of Article 49, which prohibits any kind of forcible transfer as well as the deportation of protected persons (civilians) from the occupied territory.

It must also be noted that pursuant to military order No. 1649 regarding Security Provisions a person can challenge the deportation order before a committee appointed by the military commander (“The Committee for Examining Deportation Orders”) which shall be established accordingly.

The Order does not regulate the modalities pursuant to which the appeal can be brought before the Committee; however, it is established that the person who is held in custody pursuant to a deportation order “shall be brought before the Committee as soon as possible and no later than 8 days from the date of issuance of the deportation order”.

It is evident that this system is intrinsically flawed: first of all PCHR stresses again that no genuine judicial system is possible pursuant to the Israeli military system (see the most recent PCHR Report “Genuinely Unwilling” of February 2010).
Second, according to Order No. 1650 the deportation order can be implemented within 3 days (or even less in certain circumstances), long before the 8 day time frame established for appeals hearings by Order No.1649.

It can be expected that in most of the cases the person will be deported without any possibility of challenging the order pursuant to which he has been arrested and deported.

Such a system is a blatant breach of international human rights standards, which require that every provision involving restriction of liberty must be subject to judicial review.

PCHR strongly condemns the issuance of these new military orders and calls upon Israel not to implement them.

These orders form part of the criminal policy that Israel has developed over the years against the Palestinian people; this policy combine occupation, apartheid, colonization and forced displacement of the population.

The contents of the new military orders are in blatant violation of international human rights standards and international law principles and represent one more tool in the hand of the Israeli occupation forces to control and alter the demographic composition of the oPt and ultimately impose a Jewish majority in Israel and the occupied territory.

These new orders – ostensibly enacted as ‘security measures’ – are, in fact, aimed at legitimising the forcible transfer and deportation of the civilian population of the oPt.

Israel, through its military commanders, is taking unlawful measures to eradicate the Palestinian people from their territory and take overall control of the area.

PCHR is seriously concerned about the implementation of these orders which could amount to individual or mass forcible transfer, as well as deportation of protected persons, measures absolutely prohibited under Article 49 of the Fourth Geneva Convention.

PCHR calls the international community to take action and put an end to the illegal population transfer, segregation and displacement that is taking place in the oPt and to impede the implementation of these new unlawful tools. PCHR remind that States Parties to the Geneva Convention have the duty to ensure respect for the conventions in all circumstances.

Immediate action must be taken if the international community is to prevent the aggravation of the criminal policy pursued by Israel in the oPt.

Thaise gastarbeiders in Israël systematisch uitgebuit

Ref: 18/2010

On Saturday afternoon, 20 March 2010, the Israeli Occupation Forces (IOF) killed two Palestinian civilians, including a child, in cold blood in Iraq Bourin village, south of Nablus.  IOF [Israeli Occupation Force] intentionally fired at the two civilians from a close range.  The Palestinian Centre for Human Rights (PCHR) condemns this crime, which demonstrates total disregard for the lives of Palestinian civilians.  PCHR stresses that failure to open investigation with suspected Israeli soldiers encourages them to perpetrate more of such crimes.

According to investigations conducted by PCHR and according to statements gives by eyewitnesses, at approximately 11:30 on 20 March 2010, IOF moved into the east of Iraq Borin village, south of Nablus.  A number of Palestinian boys gathered and threw stones at Israeli soldier who  immediately responded by firing, but no casualties were reported. The Palestinian boys withdrew into the village, while IOF took position in the east of the village.  At approximately 15:00, a Palestinian civil Ford transit minibus, driven by Zakareya ‘Adel Qadous, arrived in the village from Nablus.  In the meanwhile, Israeli soldiers were positioning approximately 30 miters to the east of the intersection of Iraq Borin village, were out of their jeeps.  The driver drove to the west of the village's entrance that branches to the east and to the west.  Approximately 100 meters far from the intersection, specifically in front of the mosque of the village, the driver found out that there were inflaming tires and that the street was closed.  He stopped and Mohammed Ibrahim Abdul Qader Qadous, 16, and Usaid Abdul Naser Qadous, 20, stepped down from the minibus.  As the driver turned around totravel back to Nablus, Israeli soldiers opened fire at Mohammed, who was wounded by a bullet to the heart, and Usaid who was wounded by a bullet to the head.  A number of young Palestinians who were in the scene transferred the two wounded persons to the minibus.  After the minibus drove for approximately 20 meters, Israeli military jeeps tried to stop it, but the driver managed to escape and reach Nablus Specialized Hospital.  Mohammed arrived dead to the hospital, while Usaid underwent a prolonged surgery, but he was pronounced dead on Sunday morning, 21 March 2010.  Usaid was student at an-Najah National University in Nablus.

PCHR reiterates its condemnation of this serious crime and:

1. Asserts that this crime is part of a series of war crimes committed by IOF in the Occupied Palestinian Territory, which reflect total disregard for the lives of Palestinian civilians.

2. Calls upon the international community to take immediate action to put an end to such crimes.  PCHR further renews its demand for the High Contracting Parties to the Fourth Geneva Convention to fulfill their obligation under Article 1 which stipulates “the High Contracting Parties undertake to respect and to ensure respect for the present Convention in all circumstances,” as well as their obligations under Article 146 which requires that the Contracting Parties prosecute persons alleged to commit grave breaches of the Fourth Geneva Convention.  These grave breaches constitute war crimes under Article 147 of the same Convention and under Protocol I Additional to Geneva Conventions.
