Wikileaks: Insights on Palestine from the Cables

One of the first things that struck me while reading the cables from the US embassy to Israel in Tel Aviv was how worried the Israeli government seems to be about the Goldstone Report into war crimes committed during Israel's 2008-2009 attack on the people of Gaza. In cable 09TELAVIV2777 of December 2009, Israeli Prime Minister Benjamin Netanyahu is said to have named the report as one of three "principal threats" facing Israel - the other two being Iran's alleged nuclear programme and "missile proliferation".

Second, there are important insights into the high level of collaboration between Israel and forces that have been called the "Palestinian Contras" in the occupied West Bank and Gaza Strip. Indeed, the first "cablegate" headline on Palestine was sourced from cable 09TELAVIV1177, in which Israeli Defense Minister Ehud Barak is reported to have said he "had consulted with Egypt and Fatah prior to Operation Cast Lead, asking if they were willing to assume control of Gaza once Israel defeated Hamas". In other words, Fateh leader Mahmoud Abbas (whose term as PA president expired in January 2009) knew the massive Israeli onslaught was coming but said nothing. This was widely suspected, but to read confirmation of it from a confidential US government source is something new.

There's more. Cable 07TELAVIV1732, which I like to call "War of the Puppets", was released this week. To my mind, it's the most interesting of the Palestine cables released so far. Written in June 2007 during Gaza street-fighting caused by the ultimately unsuccessful Fateh coup attempt, it details a meeting between then-ambassador Richard H. Jones and Yuval Diskin (head of Israel's secret police, the Shabak - aka Shin Bet). It is a portrait of how divided Israel's Palestinian collaborators really were. "[Gaza warlord Mohammed] Dahlan is trying to manage Fatah's security forces by remote control. We are not even sure where he is... " Diskin is quoted as saying. He continued: "[Dahlan's men in Gaza] ask us to attack Hamas. This is a new development. We have never seen this before. They are desperate." Again, this is all important corroborating evidence for things we already knew or suspected. Recent media reports of a power struggle between Abbas and Dahlan (whom Fateh elements close to the US now blame for "losing" Gaza) suggest little has changed in terms of Fateh infighting.

Diskin is also reported in 07TELAVIV1732 to have claimed the Shabak had "a very good working relationship with the [Palestinian Authority] Preventive Security Organization (PSO) and the General Intelligence Organization (GIO)." The most striking quote in the whole cable to me is this: "Diskin said that the PSO shares with ISA [Shabak] almost all the intelligence that it collects".

There is also something of an overlooked smoking gun in this cable. Of Tawfik Tirawi, leader of the PA's GIO: "Diskin said... he is trying to develop ties with the Dughmush family in the Gaza Strip.'" The Doghmush clan (aka the "Army of Islam"), you may recall, are the same group that in March 2007 kidnapped BBC journalist Alan Johnston (he was rescued by Hamas in July). While a Fateh connection to the group has long been suspected, to my knowledge this is the first confirmation of it from official sources.

Overall, this is a Palestinian Authority acting as nothing more than an extension of the Israeli occupation forces – a relationship that has only deepened in the last three-and-a-half years. However, there is a lot missing in the cables: little on the 2008-2009 Israeli assault on Gaza, nothing on the assassination of Mahmoud al-Mabhouh in Dubai and little on the July 2006 Israeli war on Lebanon. Despite some rather unlikely conspiracy theories currently doing the rounds on the internet, the likely reasons for these gaps are more mundane. First, none of the cables are rated "Top Secret"; second the inherent bias of US government personnel towards Israel; and third, only a small fraction of the leaked cables have actually been published so far. Indeed, during an interview with Al Jazeera this week, Julian Assange claimed they had thousands of cables on Israel still to come, including material on the al-Mabhouh assassination and the July 2006 war.

Also, of note is a graph illustrating the composition of the cables cache on the Wikleaks website. It appears to show that around 2000 cables from the US consulate in Jerusalem are still to come. These could be more interesting than the cables released so far (almost all from the embassy in Tel Aviv).

Will there be a strike? and if so, where? Israel: the next war

The US’s failure under Barack Obama to impose peace between Israel and the Palestinians makes a new war likely

In March 1973 the Israeli prime minister Golda Meir visited US president Richard Nixon in Washington. He told her that the Egyptian president Anwar Sadat was prepared to negotiate a full treaty, and Meir assured him that Israel wanted peace, but that she would prefer an interim agreement as Cairo was not to be trusted. She said Egypt’s primary aim was to force Israel to withdraw to the line of 4 June 1967, then resurrect the UN plan for the partition of Palestine that had been adopted in 1947; a solution to the problem of Palestine would have to be discussed with Yasser Arafat and “the terrorists”.

Israeli journalist Aluf Benn reported this conversation, on the basis of documents disclosed by Wikileaks, and drew a parallel between the situation then, when Israel’s refusal to negotiate led directly to war and to Egyptian troops crossing the Suez Canal in October 1973, and prime minister Benyamin Netanyahu’s current evasive response to President Barack Obama. Benn notes that Netanyahu, who returned from the US and rushed to the front in October 1973, “would do well to refresh his memory by listening to the tape of Meir and Nixon and asking himself what he can do to avoid repeating her mistakes and keep from dragging the country blindly toward a second Yom Kippur disaster” (1). In that war the Israeli army lost 2,600 troops.

Israel’s refusal to accept Obama’s proposal to halt settlements on the West Bank (but not in East Jerusalem) for three months in return for unprecedented promises – or bribes, according to columnist Thomas Friedman (2), who is not known for sympathy to the Arabs – confirmed that Obama is unable to exert any real pressure on Israel and that Netanyahu rejects any compromise. Netanyahu, like his predecessors, claims to want peace but he wants the humiliating peace imposed by conquest and based on denial of Palestinian rights. In secret negotiations over the past year, he has repeatedly told the Palestinians they had to accept Israel’s “security concept”, keeping Israeli troops stationed in the Jordan valley along the “barrier” (on the Palestinian side) and the occupation of a substantial part of the West Bank (3). He did not say how long the occupation would last.

This deadlock is forcing the Israeli army to draw up plans for further wars based on the “security concept” – that anyone who refuses to accept Israel’s rule in the region is a “terrorist” to be eliminated. No other country, not even the US, has such a comprehensive security concept, which means that Israel is permanently at war. Who will the Israeli army attack next? Gaza? Two years ago Israeli tanks and aircraft reduced buildings to rubble and killed hundreds of civilians in what the Goldstone report describes as “war crimes” and probably “crimes against humanity”. But Hamas is as strong as ever. How long will Israel tolerate this? Lebanon? In July-August 2006, the Israeli army failed to bring down Hizballah but succeeded in destroying the country; Hizballah is now stronger than ever and the Israeli high command cannot rule out the possibility of a major operation and occupation of part of Lebanon (4). Iran? At the risk of starting a major conflict from Iraq to Lebanon, Palestine to Afghanistan?In the Middle East unrest inevitably leads to war. This time, unlike 1973, Israel would take the first direct step, but it will face far more effective enemies and, as Israeli peace campaigner Uli Avnery points out, the hostility of world public opinion (5). Brazil, Bolivia and Argentina have recognised the Palestinian state within the pre-1967 borders and there has been a letter from 26 European elder statesmen (including Chris Patten, Giuliano Amato, Felipe Gonzáles, Lionel Jospin, Hubert Védrine, Romano Prodi, Javier Solana), who are anything but extremists, calling on the European Union to impose sanctions if the Israeli government has not reviewed its policy by the spring. Human Rights Watch published a report on 19 December (Israel/West Bank: Separate and Unequal) about the systematic discrimination against Palestinians, calling on the US government to withhold US funding from the Israeli government equivalent to expenditure on settlements (more than $1bn).

Avnery concludes: “Somebody wrote this week that America’s support of Israel is a case of assisted suicide. In Israel, assisting suicide is a crime. Suicide itself, however, is allowed by our laws. Those whom the gods want to destroy, they first make mad. Let’s hope we recover our senses before it is too late.”

Palestijnse arts begint rechtzaak tegen Israël

De Palestijnse gynacoloog Dr. Ezzeldeen Abu al-Aish verloor tijdens het bloedbad in Gaza door een Israëlisch bombardement op zijn huis in Beit Lahiya drie dochters. Vlak na het bombardement kwam hij, als vaste commentator, live in een uitzending van de Israëlische televisie. Later in het ziekenhuis, tijdens een ontmoeting met de pers, werd hij ook nog door boze Israëli's aangevallen. Het IDF noemde de dood van de drie meisjes "reasonable". De arts is een nieuw leven gestart in Canada. Na onderzoek concludeerde het IDF "niet verantwoordelijk voor de schade" te zijn. Abu al-Aish start nu een rechtzaak tegen Israël.

MediaLens: Too Toxic to Handle?

FOLLOW-UP ALERT ON ISRAEL’S POLICY OF NEAR-STARVATION FOR GAZA

On November 17, we sent out a media alert that highlighted the corporate media’s lack of interest in official documents revealing Israel’s deliberate policy of near-starvation for Gaza.

The documents had been obtained by Gisha, an Israeli human rights group, which won a legal battle in October to compel the Israeli government to release the information. The state policy relates to the transfer of goods into Gaza prior to the May 31, 2010 attack on the peace flotilla in which nine people were killed by Israeli forces. Israel still refuses to release documents on the current blockade policy, now supposedly “eased” following worldwide condemnation of the flotilla attack.

We, and many of our readers, emailed broadcasters and newspapers asking why the release of these documents was not reported in October. Were journalists simply unaware of the documents and their significance? For the BBC in particular, with all its huge resources for monitoring developments in the Middle East, this is surely implausible.

Two readers pointed out to us that the BBC had published one online story about the legal battle over the release of the documents back in May. However, BBC journalist Tim Franks accepted the Israeli assertion that the then secret documents “were not used for policy-making.”

The BBC obviously thought the story was newsworthy at the time, just as it should have last month. Indeed, the news is all the more compelling now that the documents have been released, despite the efforts of the Israeli government to block their publication. It is of major significance that explicit Israeli calculations for the amount of food, animal feed and poultry to be allowed into Gaza can be seen, starkly laid out in black and white. One of the calculated quantities is “breathing space”: the number of days that supplies will last in Gaza. The concept of “breathing space” for Gaza, dictated by the Israelis, is chilling; yet, the media appear happy to look the other way.

Finally, almost two weeks after our alert went out, an article about the Gaza blockade appeared on the BBC website in response to a new report by Amnesty, Oxfam, Save the Children and eighteen other groups. The main spin of the BBC article was that the NGOs had found “little improvement” for the people of Gaza since Israel’s claimed “easing” of the blockade which, said the groups, was “crippling” the Gaza economy. But the web article failed to emphasise the call by the NGOs for “an immediate, unconditional and complete lifting” of the illegal blockade. Tucked away at the bottom of the piece, fleeting reference was finally made to the previously secret Israeli documents:

“Last month, the Israeli government was forced to reveal that the blockade was not only imposed for security reasons.

 “After a freedom of information request by the Israeli human rights organisation Gisha, the Israeli government released documents saying the blockade was originally tightened as part of a policy of ‘deliberately reducing’ basic goods for people in Gaza in order to put pressure on Hamas.”

There was no reference to the explicit Israeli calculations on supplies of food, poultry and animal feed, or the uncomfortable truth that the Israelis had previously denied the existence of the documents; or, putting the grisly facts in context, that the documents confirmed the infamous Israeli threat that: “The idea is to put the Palestinians on a diet, but not to make them die of hunger.” (‘Hamas readies for government, Israel prepares sanctions’, Agence France Presse, February 16, 2006)

However, even a tiny mention is something, and it may well have been the result of public pressure. The fact that nobody from the BBC responded directly to the many people submitting articulate and polite challenges, and in some cases emailing follow-up queries about the corporation’s failure to reply, may in itself be significant. Perhaps BBC editors and managers realised they had been caught red-handed neglecting to report awkward facts about the Middle East.

C4 News And The Guardian: The Best Of The Rest?


The public also challenged the Guardian, the Telegraph, The Times, the Independent, ITV, Channel 4 News and Sky. Again, an amazing near-uniform silence persists (we present the two sole exceptions below).

First, Jon Snow of Channel 4 News had told one of our readers (who had emailed Snow in response to our alert) that he would be interviewing Professor Richard Falk on Monday, November 22. Falk is an expert in international affairs at Princeton University and is the UN Special Rapporteur on Palestinian human rights. The interview was confirmed in advance that day in Jon Snow’s ‘Snowmail’ bulletin which is emailed to subscribers. After Falk did not, in fact, appear on C4 News that evening, we emailed Snow and asked what had happened. In a friendly exchange, he admitted that he had “cocked up”: the interview was due to take place the following Monday, i.e. November 29. We thanked Snow and encouraged him to discuss the Israeli documents with Falk and, at some stage, to confront an Israeli government spokesperson about the policy revelations:

“... if you’re able to do anything to shed light on these documents, and to ask the Israeli spokesman some tough questions whenever you get the chance, you could be doing the public audience a huge service – and maybe, just maybe, making a real difference to reduce human suffering.” (Email from Media Lens to Jon Snow, November 23, 2010)

As it happened, C4 News of Monday, November 29 again had no interview with Richard Falk. Jon Snow did not respond to our email asking about it.

As well as the BBC contacts mentioned in our earlier alert, we also emailed Harriet Sherwood, the Guardian’s Jerusalem correspondent; Jonathan Freedland, a prominent Guardian commentator; Donald Macintyre, the Independent’s Jerusalem correspondent; and Matthew Bayley, the Daily Telegraph’s news editor.

Only the Guardian’s Harriet Sherwood responded to our email:

“I'm planning to go to Gaza in early December so I may have a look at this then. I have to say that from previous trips there is no evidence of a shortage of food in Gaza although there is clearly an issue about affordability for some sections of the population.” (Email, November 18, 2010)

We invited the independent journalist Jonathan Cook to comment on Sherwood’s response. Cook is a former Guardian and Observer journalist, now based in Nazareth, and he writes regularly on Israel-Palestine. He kindly sent us the following astute observations:

“I can no longer access Gaza myself because I have Israeli residency through marriage. But I do rely on what colleagues living in, rather than briefly visiting, Gaza tell me, and then try to use some common sense. My colleagues too say there is not an obvious shortage of food. But the problem is more complicated than simply assessing the ‘weight’ of visible food in Gaza.

“First, it is important to remember that Gaza's most pressing problems are to be found in other areas: in freedom of movement, particularly for students and the ill, in and out of Gaza; in the ability of businesses to export goods and revive the economy; in severe fuel and electricity shortages; and in shortages of raw materials needed for construction, especially given the rampant destruction caused by Operation Cast Lead in December 2008 - January 2009.

“Regarding food, much of the population, given their status as refugees, are entitled to subsistence foods from UNRWA [the United Nations Relief and Works Agency for Palestine Refugees in the Near East]. But they can only receive proper nutrition by buying in extra foods and diversifying their diet. Israel's control of the flow of food means that the restrictions have pushed up prices, making most food on the open market very expensive for families living on $2 a day. This long-term, poor diet is the reason for the high levels of malnutrition diseases among children being recorded. This is a man-made slow starvation, the very thing the Gisha documents highlight.

“Also, I think there's a dangerous journalistic practice exemplified in Harriet's comments that we are all guilty of. As reporters, we regard it as our job to walk along local streets, soaking up the atmosphere. We assume that in this way we witness and understand the problems. When we see grocery shops stuffed with tomatoes and apples, we assume things aren't too bad. But there are flaws to this approach:

“First, we may only be seeing the few shops that sell now-luxury items but not noticing that there were once many more shops. If there are shortages, many shops close either because of the lack of goods entering Gaza or because the demand has fallen as these goods have become too expensive for most Gazans. Remember that in Palestinian areas, people turn their front rooms into shops or sell from stands in the street – so there's no obvious evidence when they close their business.

“Second, the very fact, for example, that there are lots of fruit and veg in the shops that remain may in itself be evidence of the shortages. Shortages create price rises, which means fewer people can afford the goods, which in turn means they sell more slowly and ‘stay on the shelf’ longer.

“So rather than relying on our ‘sense’ as journalists of what is happening, we should rely on the best scientific evidence we have available:

“a) We know from Israel's own figures that imports into Gaza during the period to which these documents relate was about a quarter of what they were in 2007 (although this includes all goods, not just food). We also know that, after the changes, imports currently stand at only 40% of the earlier figure. This means that Gazans have been and are living off much less than they were at a time when there were already restrictions.

“b) We know from medical studies that there has been a gradual and steady rise in malnutrition rates.

“c) We also know from these documents that the Israeli government had a policy during this period to impose a minimum diet on Gazans, and is now refusing to divulge its new policy.

“Taken together, that is very good evidence that Israel wanted to slowly starve Gaza and in fact did so. In those circumstances, the impressions of Harriet and other journalists are largely irrelevant.” (Email from Jonathan Cook, November 18, 2010)

We put these points to Harriet Sherwood of the Guardian. We also referred back to her email in which she said:

“I'm planning to go to Gaza in early December so I may have a look at this then.”

We suggested to Sherwood that her casual wording implies that she does not find the release of these important Israeli state documents newsworthy. We reminded her that the existence of these documents had been previously denied by Israel; not surprising, given that they document a deliberate and systematic policy of collective punishment of the entire population of Gaza. We have not heard back from the Guardian’s Jerusalem correspondent.

Note again Sherwood’s sanguine observation:

“I have to say that from previous trips there is no evidence of a shortage of food in Gaza although there is clearly an issue about affordability for some sections of the population.”

Jonathan Cook pointed out to us in a second email:

“Actually her response simply sets out the conundrum rather than answers it. 

“If there is no shortage of food, why has it become unaffordable for some sections of the population? True, some Gazans are probably poorer, but, even taking this factor into account, we also know prices have risen substantially. How do we explain these rises when the population is actually poorer? How do we make sense of it?

“It worries me that as journalists we make these kinds of statements without thinking through the logic of our own assumptions.” (Email from Jonathan Cook, November 18, 2010)

Concluding Remarks


In almost ten years of observing the media and writing alerts for Media Lens, we still sometimes find ourselves amazed by the efficiency of the corporate blanking of uncomfortable truths. There is no need for organised obstructionism here; no requirement for orders from above, or ruthless spiking of news stories.

As George Orwell noted in an unpublished preface to Animal Farm:

 “The sinister fact about literary censorship [...] is that it is largely voluntary. Unpopular ideas can be silenced, and inconvenient facts kept dark, without any need for any official ban”.

In drawing our attention to Orwell’s remarks, Noam Chomsky describes the mechanism of achieving this dark silence as “the internalisation of the values of subordination and conformity” (Noam Chomsky, ‘Powers and Prospects’, Pluto Press, 1996, p. 68).

“A good education and immersion in the dominant intellectual culture”, adds Chomsky, instils in policy-makers, commentators and academics a “general tacit agreement that ‘it wouldn't do’ to mention that particular fact.”  

But the public has the power to ensure that “particular facts” do get mentioned. And, crucially, we have the power to make Western governments end the oppression of people in Gaza, and around the world.

Joodse vredesboot 'Irene' naar Gaza, wat wij niet mochten weten

Op zondag 26 september vertrok een kleine boot (catamaran) met 7 joodse vredesactivisten van Jews For Justice For Palestine en goederen naar Gaza. De boot heette 'Irene' en voer onder Britse vlag. De boot vervoerde speelgoed, schoolboeken, muziekinstrumenten en visnetten.

In Nederland was 'Boot met joodse activisten onderweg naar Gaza' groot nieuws, en elke krant en nieuwsmedium berichtte erover. Toen de boot, alweer in internationale wateren, door Israëlische commando's werd geënterd was de journalistieke 'euforie' al tot de helft gereduceerd. Over hoe de entering in zijn werk ging hebben we in Nederland alleen uit monde van Israël kunnen vernemen: het gebeurde "op vreedzame wijze" en "verliep zonder problemen". Aan wederhoor is nooit gedaan. De bekende pro-Israël en zionistische weblogs verzwegen de joodse actie volledig, alsook de joodse organisaties in Nederland. Behalve Kees(-jemaduraatje) Broer die traditioneel weer verviel in zijn archaïsche katholieke antisemitisme.

On the Irene that fateful Tues morning, the weather was beautiful as the sun reflected a mirage of gold on the Mediterranean. It was the day we would have reached Gaza and we were now close to 20 miles from shore but still in International waters. At 9 AM we sighted warships on the horizon moving towards us. Soon we could see the guns and war paraphernalia on board. It was all so surreal. Surely this was not really happening? I felt I was watching a war movie. Several smaller frigates moved too close to us, one in the front, back and on both sides sides. What act of insanity could this be? For a moment I imagined myself escaping, our small boat of tired Jews surrounded by the Nazi navy but I moved quickly away from this thought. Instead, try to imagine in the same space as the warships, a fleet of 4 or 5 pleasure sail boats gliding along as if nothing was happening. It was ludicrous to see pleasure sail boats n the same waters as the warships. Did they feel protected from the enemy “terrorists” on the small sailboat, by the big Navy fleet? Keep in mind we were a tiny unarmed boat dressed with wonderful flags including the Palestinian flag and dozens of names of potential passengers surrounded by doves sewn by Edith.

All I could think of is why are these warships coming to board our little catamaran with 9 Jews mostly in their 60’s 70’s and 80’s? How did it come to this, Jew against Jew? What insanity brought these soldiers dressed to the gill with high boots, tasers, guns, helmets and gloves with their fingers uncovered to take over our boat, in essence to kidnap us? One soldier tire down and ripped apart our beautiful flags while we huddled close together, hands linked and sang “we shall overcome.” Although the Israeli press described the kidnapping of our boat as without incident, it was anything but that. We were one in our stance of passive resistance and non violence. It was crazy as they boarded in large numbers. One had to see this to believe it as a few of them kicked Glyn until he fell as he held onto the wheel. It was all so brutal, so completely unnecessary, insane. They ceased to be human as they dragged Itamar to their frigate, tied his hands and kicked him as he lay flat on his back, his hands tied. Jonatan was by then trying to quiet 82 year old Reuven who lost it when his harmonica’s fell to the floor where they were about to be stepped on. Reuven with a pacemaker inside him became agitated and screamed at the scary looking steely faced soldiers that they should be ashamed of themselves. Luckily we rescued the harmonicas but at that moment I knew if the Mavi murders had not happened, they could have shot Reuven or any one of us. Instead restraint had most likely been ordered. Then we heard a scream. These military robots, 3 or 4 of them had knocked Yonatan onto the ground, pulled away his life jacket and tasered him in his heart. His cry like a wounded animal is something I will not forget. Unconscious, they dragged him onto the frigate.I saw first hand the dehumanization and the brutality. They picked on 2 true heroes of Israel and I suspect targeted them to hurt them. Since Glyn had made sure the engines would not work, we were towed to Ashdod at a speed of 10 knots, twice as fast as this boat was able to do for we had sailed no faster than 5 knots. We thought the boat could break in two and sat anxiously in our life vests. But this wonderful boat held out for us.

And now we were towed to Ashdod. It was brutally hot as we were herded from the boat into a courtyard. To get there each of us had to be pulled up a steep stone wall one by one. I noticed someone had pulled away a ladder which would have been less humiliating and easier for us. During our individually performed searches, all cameras, computers and cell phones were confiscated. I soon found myself in a well guarded van with tightly closed shades as we had become prisoners that had been arrested. I was happy to see Edith in the van. Her clothes were still wet from partial flooding on our boat while being towed at such a rapid speed. Despite the heat, she was shivering. I did not know then where the rest of us were. Edith and I were taken to Holon, about an hours drive on the outskirts of Tel Aviv while loud music roared in our ears. All we could say to one another was to acknowledge Israel as a state of collective mental illness.

Klacht bij Belgische rechtbank tegen Israël wegens aanval Flotilla

Twee advocaten van het Progress Lawyers Network dienen een klacht in tegen Israël bij de Belgische federale procureur. Ze doen dat in naam van de vier Belgische slachtoffers van de Gaza Flotilla. De klacht luidt: mensrechtenschendingen tijdens de militaire aanval op de Freedom Flotilla, eind mei. Op een persconferentie donderdag in Brussel gaven ze tekst en uitleg.

De Belgische deelneemsters aan de Free Gaza Flotilla van einde mei, Griet Deknopper, Kenza Isnasni en Fatima El Mourabit kondigden aan dat er in de lente van 2011 opnieuw een Free Gaza Flotilla zal proberen de blokkade te doorbreken. Dit keer met nog meer deelnemers. Ze riepen de Belgische overheid op om hierover een duidelijk standpunt in te nemen.



Misdaden tegen de menselijkheid tijdens de aanval tegen de Flotilla

Twee advocaten van het Progress Lawyers Network dienden woensdag een aanvraag in bij de Belgische federale procureur om een onderzoek te starten tegen mensenrechtenschendingen die zijn gebeurd tijdens de Israëlische aanval op twee boten van de Freedom Flotilla.

Het gaat om de aanval op de Mavi Marmara en de Challenger I. Want op die twee boten zaten de Belgische slachtoffers. De klacht is vooral gericht tegen de drie Israëlische verantwoordelijken voor de militaire aanval: vice-admiraal Eliezer Chiney Marom, generaal Gabi Ashkenazi en tegen de minister van Defensie Ehud Barack.

Volgens advocate Julie Tieleman omvat de klacht mishandelingen en mensenrechtenschendingen. "Griet Deknopper is beschoten met een geluidsbom, en heeft nadien geen verzorging gekregen. De vier zijn 72 uur onwettelijk vastgehouden zonder tussenkomst van een rechtbank. Ze moesten lang in de kou en in de regen zitten. Fatima El Mourabit werd op een pijnlijke manier geboeid. Ze zijn alle vier gedeporteerd naar een derde land, Turkije, hoewel ze geen burgers waren van dat land. Ook dat is een schending van het internationaal recht."

"Daarnaast zijn al hun goederen zoals laptops, camera's, en ander bewijsmateriaal afgenomen door het Israëlische leger. Zonder er een bewijs van confiscatie te hebben gekregen wat wettelijk moet. Ook al hebben ze bewijsmateriaal en beelden afgenomen er zijn nog andere mogelijkheden om de aanklachten hard te maken. Zo zijn er verschillende internationale onderzoeken (onder meer van de VN) die slachtoffers hebben geïnterviewd. Die hebben los van elkaar gelijkaardige verklaringen afgelegd", aldus advocate Julie Tieleman.

Artikel 10

De schendingen van de mensenrechten zijn gebeurd buiten België, maar kunnen volgens advocate Joke Callewaert toch door een Belgische rechtbank behandeld worden op basis van artikel 10 van het strafwetboek. Voordien liet de zogenoemde 'antigenocidewet' een dergelijke procedure toe, maar die is fors afgezwakt na politieke druk uit de VS.

Volgens artikel 10 van de Belgische strafwet kan voor misdaden tegen de menselijkheid, oorlogsmisdaden of een genocidemisdaad, gepleegd buiten het eigen grondgebied, een strafrechtelijk onderzoek opgestart worden in België. Er zijn wel enkele voorwaarden aan verbonden. Zo moet er een zekere band zijn met België. Slachtoffers moeten ofwel de Belgische nationaliteit hebben of op het moment van de feiten al twee jaar in België verblijven.

Wat gebeurt er met de klacht?

De Belgische federale procureur kan beslissen dat de klachten ongegrond zijn en de zaak zo laten, ofwel de klacht gegrond verklaren. Dan moet de zaak ofwel in België onderzocht worden of doorgestuurd worden naar het Internationaal Strafhof (ICC). "België kan bijvoorbeeld ook beslissen dat de zaak in Israël moet onderzocht worden, maar daar zijn we tegen", zegt advocate Callewaert. "We vinden dat Israël die zaak niet onafhankelijk kan onderzoeken."
Klacht realistisch of louter symbolisch?

"De feitelijke klacht is realistisch", zegt Joke Callewaert. " We hopen dat er een procedure van komt of tenminste een discussie voor een Belgische rechtbank. We hopen ook dat als de klacht wordt doorgestuurd naar het Internationaal Strafhof deze zich zal uitspreken." Volgens Griet Deknopper gaat het vooral om de druk die ze willen opvoeren tegen de illegale acties van Israël.

Klachten bij het Internationaal Strafhof

Er lopen momenteel al drie klachten tegen Israël bij het Internationaal Strafhof in Den Haag. Turkije en Spanje hebben er al een klacht ingediend. En de Palestijnse Autoriteit heeft nog een klacht lopen tegen Israël wegens oorlogsmisdaden tijdens de oorlog tegen Gaza van januari 2009. "De procureur van het Internationaal Strafhof moet die zaken normaal gezien inleiden bij de rechtbank, maar laat ze liggen. De kans is groot dat bij politiek geladen zaken een klacht gewoon in de vergeethoek geraakt", zegt advocate Callewaert.

Mobilisering in de lente 2011

Kenza Isnansi, één van de Belgische deelneemster aan de Gaza Freedom Flotilla van mei 2010, trekt samen met de andere Belgische deelneemsters de BelgiumToGaza-beweging. BelgiumToGaza is een platform van Belgische organisaties en individuen dat zich engageert om de illegale blokkade van de Gazastrook aan te kaarten.

Ze organiseert allerlei activiteiten om fondsen in te zamelen voor de volgende Flotilla, die normaal in de lente van volgend jaar naar Gaza zal varen. Het wordt een nog grotere vloot, met nog veel meer volk, zegt Isnansi. De twee grote koepels, European Campain to End the Siege of Gaza en de Free Gaza Mouvement, organiseren een boot die groter zal zijn dan de Mavis Marmara. Er wordt gemobiliseerd om een Belgische delegatie mee te sturen.

De deelneemsters aan de vorige Flotilla roepen de Belgische regering op om een duidelijk standpunt in te nemen over de Flotilla.

Kenza, Fatima en Griet weten zelf niet of ze zullen deelnemen aan de volgende Flotilla. "Voor ons is het vooral belangrijk dat we de acties steunen en mobiliseren", zegt Griet. "We zijn met een duidelijk doel naar Gaza vertrokken, we willen de blokkade opheffen. De komende Flotilla heeft hetzelfde doel. We gaan niet akkoord met een verlichting van de blokkade, maar willen de volledige opheffing ervan", aldus Fatima El Mourabit.

Op de website israeliwarcriminals.zzl.org werden gisteren gegevens van 200 Israëlische oorlogsmisdadigers gepubliceerd. Inmiddels is de website onbereikbaar. Links naar de website worden op Facebook overal verwijderd, ook de verkorte url's die via redirectors lopen.

De inleiding van de site luidt: "De volgende personen zijn rechtstreekse daders die van december 2008 tot januari
2009 honderden mensen aanvielen in het belegerde Gaza. (..) Ze hadden posities waarin ze bevelen gaven tijdens de aanval en daarom handelden ze niet enkel uit naam van een systeem van een moordende staat, maar moedigden actief anderen aan hetzelfde te doen."
